裝人工陰莖引發疼痛　壯男求償717萬敗訴

【法庭中心╱台北報導】39歲許姓男子自稱腎結石至台北醫學大學附設醫院就診，林姓醫生卻診斷他有性功能障礙，4天後植入長19公分的人工陰莖，但術後卻發生傷口疼痛、感染，陰莖歪一邊及精神障礙，他認為手術失敗，害他無法有正常性生活，至高雄榮民總醫院換另一款式人工陰莖，並向北醫及林姓醫師求償717萬元；今遭台北地院判敗訴。

北醫指出，許男2010年1月求診時就說有性功能障礙，且服用威而鋼交果不佳，醫師原本建議他再服藥，但許男卻要求動手術，許的傷口回診治療時並無發炎，後來，許男於2012年至高雄榮總再動手術換人工陰莖，另再至台北市聯合醫院仁愛院區住院，北醫並無疏失。

台北地院審理認為，北醫並無任何疏失，許男控林姓醫師刑事業務過失傷害罪已不起訴，且許男病歷顯示，他有精神分裂症，有被害意念，許男術後自認感染，至多家醫院求診，但鑑定後卻都未發現有發炎，法官認為，這可能與許男精神分裂症所生的妄想有關。
